Terms of Service

• You must be at least 18 years old to create an account and use the Service.
• You may register using an email address, phone number, or your Google account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
• Accounts are assigned one of the following roles: Artist, Gallery, Collector, or Viewer. Each role determines what actions you can perform on the platform. New accounts are assigned the Artist role by default.
• You may not create accounts on behalf of another person without their explicit consent, or for the purpose of fraud, impersonation, or abuse.

Artenthic's core service is the sale and management of NFC tags that physically link artworks to their digital provenance records.

• Purchasing tags — NFC tags are sold as physical items. Prices are listed in Indian Rupees (INR) and include applicable taxes. All sales are final unless the tag is defective on arrival.
• Ownership — upon successful payment, one NFC tag is created per unit purchased and linked to your account. Each tag is assigned a unique 16-character token.
• Artwork binding — you are responsible for correctly attaching tags to the artworks they represent. Artenthic is not responsible for incorrect tagging or for physical damage to tags after delivery.
• Provenance accuracy — by submitting artwork and provenance data, you confirm that the information is accurate and that you have the right to register the work. Submitting false or misleading provenance data is a breach of these Terms.

• All payments on Artenthic are processed by Razorpay, a PCI-DSS compliant payment gateway. By completing a purchase, you also agree to Razorpay's terms and privacy policy.
• Prices are quoted in Indian Rupees (INR) inclusive of applicable GST unless stated otherwise.
• Your payment is confirmed only after Artenthic verifies the HMAC signature returned by Razorpay. If verification fails, your order will not be completed and no charge will apply.
• Artenthic does not store your full card details at any point. Payment references (order ID, payment ID) are retained for accounting and dispute resolution.
• For refund requests arising from a platform error or defective product, contact [email protected] within 7 days of your order date.

• Your content — you retain all rights to artwork images, descriptions, and provenance records you upload. By uploading content, you grant Artenthic a non-exclusive, royalty-free licence to display and store that content solely for the purpose of operating the Service.
• Platform content — the Artenthic name, logo, design, software, and all other platform content are the intellectual property of Artenthic and may not be reproduced, distributed, or used without our written permission.
• Prohibited submissions — you may not upload content that infringes the copyright, trademark, or other intellectual property rights of any third party. We reserve the right to remove such content and suspend the responsible account.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Register artworks you do not own or have authorisation to register.
• Attempt to reverse-engineer, scrape, or otherwise access the platform's source code, APIs, or infrastructure without authorisation.
• Interfere with the integrity of NFC tag records, including attempting to clone, counterfeit, or transfer tags outside of authorised platform flows.
• Circumvent authentication mechanisms, including OTP verification or HMAC payment signature checks.
• Submit fraudulent payment information or dispute legitimate charges in bad faith.

Violation of these rules may result in immediate account suspension and, where applicable, referral to law enforcement.

• You may close your account at any time by contacting [email protected].
• We reserve the right to suspend or terminate accounts that breach these Terms, with or without prior notice depending on the severity of the breach.
• Upon termination, your access to the Service ceases immediately. Provenance records and NFC tag histories associated with artworks already registered are retained as part of the immutable record — they cannot be deleted on request.

The Service is provided "as is" without warranties of any kind, express or implied. Artenthic does not guarantee that provenance records stored on the platform will be accepted by every third-party institution, marketplace, or insurer.

To the fullest extent permitted by law, Artenthic's total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid to Artenthic in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential losses.

These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of India. If you are using the Service from another country, you are responsible for compliance with local laws.

We may revise these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, sending an email to the address on your account. Continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms.
